I am committed to protecting and respecting your privacy. I comply with the General Data Protection Regulations of 2018. This notice (together with my terms of business) will set the basis on how I process, collect, manage and store your personal details, including your rights under the General Data Protection Regulations (GDPR). I am registered with the Information Commissioners Office (“ICO”) under number ZA026382.

Please read the following to understand my views and practices regarding your personal data, including the conditions under which I may disclose it to others and how I keep it secure.

INFORMATION I COLLECT FROM YOU

The information that will be requested from you will depend on what you have instructed me to do. There are two forms of data that you may provide me with: - Personal Data which is the general information that you supply about yourself – such as your name, address, gender, date of birth, contact details, financial information etc. Sensitive Personal Data which is a more sensitive type of information and may include your race or ethnic origin, religion, sexual orientation, details of your physical and mental health, philosophical views, bio-metric and genetic data etc. For the work I do I will request personal data from you to perform standard identification checks. However, in some case there may be a requirement for more sensitive data. These two forms of data will be treated in conjunction with the GDPR guidelines. I will also retain copies of the documents I notarise with other supporting documentation.

How is your data collected?

The information that I obtain from and about you can be obtained through a range of different sources; including: - -You may volunteer the information about yourself, either verbally, by filling in forms, physically providing information and/or on my site or social media networks. - If you have authority to do so, you may provide information about someone else. - A third party may provide the information, for example; a bank or building society, panel providers, estate agents, medical or financial institutions etc.

This website is hosted by Squarespace. Squarespace collects personal data when you visit this website, including:

  • Information about your browser, network and device

  • Web pages you visited prior to coming to this website

  • Your IP address

Squarespace needs the data to run this website, and to protect and improve its platform and services. Squarespace analyzes the data in a de-personalized form.

WHY I NEED THE INFORMATION

The main reason for me asking you for your personal information is so to carry out your instructions, which in most cases will be to carry out the work requested by you. I will only ask for what I need and will adhere to GDPR rules of transparency. You do not have to provide information to me however I will not be able to provide the services you have requested if you do not provide me with all or part of the information I have requested. I will not request more information than I require. If you are acting in your capacity of Power of Attorney or otherwise acting on someone else’s behalf I also process the data relating to that person. You warrant that you have authority to provide such information to me.

WHAT IS THE INFORMATION USED FOR?

A few reasons for why I would use the information you have provided are as follows: - Communication with you - Processing and completing documents - Preparing documentation for you - Seeking advice from third parties - Prevent and detect crime, fraud or corruption - Responding to a complaint or allegation of negligence against me.

WHO HAS ACCESS TO IT

I have various data protection processes in place to ensure that I am adhering to the GDPR and to oversee the effectiveness and secure processing of your personal data. Any staff with access to your information have a duty of confidentiality under the ethical standards that I am is required to follow. I will not sell or rent your information to third parties and will not share your information to third parties unless I have your permission or are required to do so by Law. Generally, I will only use your information within my business. However, there may be circumstances whereby, in order to carrying out the work which I have been instruction to do, I will disclose relevant information to third parties; some of which include: - - HM Land Registry - HM Revenue & Customs, courts and other organisations entitled to require disclosure and (in respect of public acts, any third party) - Courts & Tribunals. In the event that any of your information is shared with any of the above mentioned third parties, I ensure you that they comply strictly and confidentially with my instructions and they do not use your personal information for their own purposes unless you have explicitly consented to them doing so. In some cases, I may require your consent to disclose your personal data to a third party. If this is the case I will contact you separately to ask for your consent, of which you are free and able to withdraw from at any time.

HOW DO I PROTECT YOUR DATA?

I understand that your information is valuable and therefore it is my responsibility to ensure that I am taking the appropriate steps to protect and store this data whilst it is in my care. I have high standards of technology and operational security to protect any confidential information stored from loss, misuse, alteration or destruction. I work hard to ensure that all personal data is handled and processed in accordance with my data protection policy. For my computers I use computer safeguards such as firewalls. For physical storage I have a range of physical access controls and barriers to keep physical data secure.

HOW LONG DO I STORE YOUR DATA?

Your personal data will be retained so long as I practice. When I cease to practice your personal data will be transferred to another Notary. This may be through computer storage facilities and/or physical storage facilities. Your information will be kept as long as I am required to keep such information.

WHAT ARE YOUR RIGHTS?

Under General Data Protection Regulations, you are entitled, at any point, to access your personal data. If you wish to make a request, please do so in writing. A request for access to the personal data which I hold will entitle you to a description of what I am holding, why I am holding it, who it could be disclosed to and to provide you with a copy if requested. I reserve the right to make an administrative charge if copies are requested. It is also within your rights to rectify any mistakes in the data I hold, to object or erase any data that I hold (with a legitimate reason) and also to restrict the processing of data.

COMPLAINTS ABOUT THE USE OF PERSONAL DATA

If you wish to raise a complaint on how I have handled your personal data you can raise this with me. If you are still not satisfied with my response or believe I am not processing your personal data in accordance with the law, you can forward your complaint to the ICO.

Use of Technology, Devices and Artificial Intelligence

(1) To the extent that I use any automated decision-making technology, including artificial intelligence, in the course of my services, I do not rely upon the same without human intervention.

(2) Before using any new technology including artificial intelligence, I carry out an appropriate risk assessment to ensure that your rights are not adversely affected by the same.
